California Non-Operation?

Legal Monkey asked:

I just bought a used car from a private party who had paid registration for Non-operation of the vehicle. I obviously want to drive the vehicle. How does the DMV determine the fee for registration to change the Non-operation status to operational? Is it the full-operation fee, or do they take the difference between the two fees?

Please note that this is a California registration.

Please no “guess” answers. I’m only looking for answers from people with prior experience or a law student who can cite the vehicle code section.

You have to pay the fee for the current year, plus the transfer fee. You won’t recieve the registration until you provide a recent smog check. They will give you a temporary permit (30 days usually) to have the smog check done.

If the car hasn’t had tags for a couple of years as long as the non op on it has been paid you only have to pay this years tags and not the past ones. Hope that helps! Good luck!

I KNOW THAT YOU ARE RESPONSIBLE FOR ALL OF THE FEES EXCEPT THE SMOG FEE WHICH IN THE STATE OF CALIFORNIA THE SELLER MUST PAY FOR THIS BEFORE THE SALE.
